The Mediation Process is governed by rules of procedure and conduct, and begins with the disputing parties meeting with the mediator in private, confidential sessions to:
Establish communication
Identify issues to be resolved
Recognize how emotions affect decisions
Explore creative, realistic options
Communicate directly and negotiate solutions
Develop realistic plans for settlement

Upon mutually reaching an agreement, separate attorneys, representing each party, review and advise on the agreement and prepare final court documents. Parties cannot be compelled to settle. The disputing parties always maintain the option to go to trial.

The mediator will not play an adversarial role. Instead, impartiality will be maintained with all participants. Any relationship or circumstance that might reflect a conflict of interest will be disclosed. All mediators will maintain confidentiality within the guidelines of the law and adhere to all ethical and professional standards.

Professional fees and payment will be discussed prior to beginning the mediation process.
